The Oui Gruppe GmbH & Co. KG, its subsidiaries and partner companies (hereinafter referred to collectively as “Oui”) attach great importance to the protection and security of your personal data, your privacy and your right to determine what information is held about you. Oui only collects, processes, stores and uses your personal data during your visits to its online store and website in accordance with the principles outlined below and in compliance with the German Federal Data Protection Act, the EU General Data Protection Regulation, and the German Teleservices Act.
Data protection and information security form an integral part of Oui’s corporate philosophy.
1. Your personal data/Purpose limitation
Personal data represents the individual details of personal or material circumstances, which could be used to establish a link to you. This data includes, for example, your name, telephone number and postal and e-mail addresses.
Oui, or third parties commissioned by Oui, adhere strictly to the purpose limitation and only use your personal data for the purposes authorised by you. Employees of Oui and all contracted service providers have been obliged by Oui to maintain the confidentiality and secrecy of data, as well as to adhere to the provisions of the GDPR and other data protection legislation.
2. Collection and Use of Your Personal Data
As a basic principle, your personal data will only be collected and used when visiting the Oui website if you provide it to Oui, of your own accord, for the particular purpose, for example, by means of registration or to enter into a contract, for which you have given your authorization. When visiting the website, you will be asked to provide personal data at various times. Oui collects or uses this data
a) to receive and process your order
b) to collect outstanding payments,
c) to receive and process your inquiries,
d) to legitimately conduct a credit check,
e) and if you have separately agreed to this, to send you newsletters,
f) for the statistical analysis of page views and orders,
g) for other technical purposes.
h) for the integration of social media plugins
These points are explained in greater detail below:
a) Use of your personal data in order to receive and process your order
Oui uses your personal data, which you provide during the actual purchasing process on the website, in particular, your name (first name and surname), address, telephone number, e-mail address, credit card number, date of birth and bank account details, where this is necessary to process and invoice your order.
To progress your order, Oui transmits your personal data to a logistics provider commissioned by Oui, which processes this data on behalf of Oui and in compliance with these data protection regulations as well as the necessary security measures.
b) Use of your personal data to collect outstanding payments
Oui uses your personal data, which Oui has collected and stored to receive and process your order, to collect outstanding payments. For this purpose, Oui appoints a debt collection company to which Oui transmits the data needed for debt collection and which subsequently processes the data in compliance with these data protection regulations as well as the necessary security measures.
c) Use of your personal data to process your inquiries
Oui also collects and uses your personal data to be able to deal with suggestions or comments you have submitted to Oui (for example, via a contact form on the website).
d) Credit check by Creditreform Boniversum GmbH or by another company
Oui transmits certain information, which you have provided to Oui as part of the ordering process, to carefully selected service providers, which check your creditworthiness. The data transmitted to these companies includes your first name and surname, postal address, date of birth and, where applicable, your credit card details. These service providers check for the existence of negative information relating to your creditworthiness and determine your “Score”. A “Score” uses a statistical process to predict the risk of a possible payment default on the basis of known empirical values. These service providers are currently SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden and Creditreform Boniversum GmBH, Hellersbergstr. 11, 41460 Neuss and Bisnode Austria GmbH, Geiselbergstraße 17-19, 1110 Wien, Austria. Information on the data processing undertaken by Creditreform Boniversum in accordance with Art. 14 of the EU General Data Protection Regulation can be found here: www.boniversum.de/EU-DSGVO
Notwithstanding the above, Oui will also transmit to these companies data resulting from non-contractual behavior, where this is admissible after balancing all the interests of the parties involved. These companies store and transmit the data to their contractual partners within the EU internal market, in order to provide the latter with information for credit checks on individuals. You may obtain information from SCHUFA or the other companies regarding the data they store relating to you. Further information on the SCHUFA Information and Scoring Process are provided in an information sheet, which can be obtained, on request, from SCHUFA’s contractual partner (at www.meineschufa.de/score).
e) Use of your personal data to send you newsletters (for marketing purposes)
Where you have expressly consented to this, Oui collects and uses your personal data, in particular your name (first name and surname), address, e-mail address and date of birth to send you more information on Oui’s products and special offers, such as birthday mailings or customer surveys, as well as general customer information. This information may be sent by e-mail or via a conventional postal service.
Where Oui has received an e-mail address from you in connection with an order placed in the shop, Oui will use this for direct advertising for its own similar goods or services, unless you have refused to consent to this use. Naturally, Oui indicates clearly when collecting your e-mail address and each time it is used that you have a right to withdraw your consent for this use.
If you would like to receive this newsletter, we need your email address and additional information that will allow us to verify that you are the owner of the email address provided and that you agree to receive the newsletter.
We use a double opt-in procedure so your contacts receive only the emails they've agreed to get. In order for a potential subscriber to sign up for a newsletter, they have to complete all the steps of this process. This process is complete (and legally watertight!) once a user has clicked on the confirmation link in the double opt-in email. Their email address will be activated in your contact list only once they've confirmed their subscription.
We use this data exclusively for sending information and offers you have requested.
Newsletter2Go is the email marketing software used. This means your information is transmitted to Newsletter2Go GmbH. Newsletter2Go is prohibited from selling your data and from using it for purposes other than sending email. Newsletter2Go is a certified German email marketing software provider, working in accordance with the European directive 95/46, as well as the German Federal Data Protection Act (BDSG).
When you give a company permission to store your personal information and email address and to send you marketing emails, you can revoke this consent at any time via the unsubscribe link in every mailing.
Data protection measures are always subject to technical innovations. For this reason, we ask you to inform yourself about our data protection measures at regular intervals by consulting our data protection policy.
f) Use of your personal data for the statistical analysis of page views and orders (web analysis tools)
The Oui website uses Google Analytics, a web analysis service provided by Google LLC (“Google”) a subsidiary of Alphabet Inc.. Google Analytics uses so-called "Cookies" (see no. 4. below), which facilitate analysis of your use of the website. The data generated by Cookies regarding your use of the website includes, for example, your shortened IP address. Shortening your IP address anonymizes your data, which means that it is no longer possible to identify you as a website visitor. The data anonymized in this way is sent to Google in the USA and stored there. Google will use this anonymized data to evaluate the use of the website, to compile reports on website activity for Oui as the website operator and to provide other services relating to website activity and internet use. Google may also, potentially, transmit this anonymized data to third parties, where required to do so by law or where these third parties process this data on behalf of Google. Under no circumstances will Google link your anonymized IP address with other Google data. Users can prevent the installation of Cookies with the corresponding setting in their browser; in this case, it may not be possible to use the full functionality of this website.
g) Use of your personal data for other technical purposes
When you visit the website, Oui stores the following information as standard:
- your IP address, the website from which you are visiting Oui (referrer)
- the web pages, which you visit at Oui (pages),
- downloaded files
- views of video/audio material
- clicks on individual links
- search words or search phrases (site search), as well as
- the date and length of your visit
- your browser type
- your browser settings
- your operating system
- the pages visited by you
If you visit the Oui website via an online advertisement using, for example, banner, video ads, search engine advertising, we also record which banner or adword has led you to visit the website.
h) Use of your personal data for the integration of social media plugins?
The Oui website occasionally contains links to third-party websites. Once you click on any of these links, Oui no longer has any influence over the collection, storage or processing of any personal data transmitted to third parties by clicking on the link (including, for example, the IP address or URL of the site where the link is located), as, by its very nature, the behaviour of third parties is beyond the control of Oui. Oui cannot be held liable for the processing of any such personal data by third parties.
3. No transmission to third parties
Oui will not transmit your personal data to third parties, in particular your first name and surname, without your prior consent, unless we are legally obliged to disclose this data, for example, when instructed to do so by a public prosecutor or a court order. Your personal data is only stored and used in the Federal Republic of Germany.

Before Oui uses your personal data to send you newsletters, Oui will ask for your explicit consent. You have the opportunity, at any time and without giving a reason, to withdraw your consent with future effect. Withdrawal of your consent must be sent by e-mail to firstname.lastname@example.org. Naturally, in this case, Oui will no longer use your data for this purpose.
You have given Oui your explicit consent to the following during the ordering process, or optionally in relation to receiving newsletters:
1) Credit check
To determine the individual payment types offered, you consent to a credit check, if necessary by third parties, as well as storage of your IP address.
2) Newsletter subscription separate from an order in the online shop
You would like to become a Oui VIP and be kept up to date on all news & special offers. You can cancel your newsletter subscription at any time.
6. User profiles
Oui creates user profiles, using pseudonyms, for the purposes of advertising and market research and to improve its services. These user profiles are not merged with data relating to the bearer of the pseudonym. You may refuse to consent to this use.
7. Duration of data retention and information on your personal data, updating and deletion
As a matter of principle, Oui will not store your data for longer than is necessary for the purposes stated in these data protection regulations or in order to comply with any legal archiving or other retention obligations. Naturally, on request, Oui will inform you whether and which personal data relating to you is stored by Oui. Oui constantly makes every effort to ensure that your data is accurate and up-to-date. Nevertheless, should incorrect information have been stored, please inform Oui of this, in order for Oui to rectify this immediately. To do this, please contact Oui by e-mail at email@example.com.
